The Bellinzona criminal court president dealt with an objection to a criminal accusation decree. Before the scheduled public hearing, the opponent withdrew the objection by letter of 4 September 2003. The court therefore struck the case from the docket, declared the accusation decree enforceable, cancelled the hearing set for 17 September 2003, and remitted the file to the public prosecutor for further action. Court costs of CHF 80 in total, consisting of a CHF 50 justice fee and CHF 30 judicial expenses, were charged to the opponent.

The withdrawing opponent bears the procedural costs ordered in the strike-out decision. The decision is purely procedural and does not address the merits of the criminal accusation (consid. 1-3).
