The Second Civil Chamber of the Ticino Court of Appeal dealt with a direct appeal filed by AT 1 against CV 1. After the proceedings had been suspended, counsel for the appellant informed the court that the parties had settled the dispute out of court and requested removal from the docket. The court held that the case had become devoid of object and struck it from the register. In accordance with the parties’ settlement, court costs remained with the appellant and party costs were compensated.
Art. 351 CPC; strike-out of proceedings after extrajudicial settlement and allocation of costs: if the parties notify the appellate court that the dispute has been settled and request discontinuance, the appeal becomes moot and is removed from the docket. Where the parties additionally agree on costs, the court gives effect to that agreement; in particular, court costs may be left to one party and party costs compensated (consid. 1-2).

vista la petizione proposta direttamente in appello il 12 novembre 2003 da

decisa per acquiescenza la domanda cautelare dell’attrice con decreto 3 dicembre 2003 e relativa fissazione di spese, tasse e ripetibili di quella sede;
visto l’allegato di risposta 13 febbraio 2004;
sospesa la causa il 15 marzo 2004 ai sensi dell’art. 107 CPC;
preso atto dello scritto 10 gennaio 2005 del patrocinatore dell’attrice che a nome di entrambe le parti comunica che la vertenza è stata risolta in via stragiudiziale, chiedendo, di conseguenza, lo stralcio dai ruoli della procedura;
preso pure atto che nello stesso accordo le parti hanno convenuto di assumersi le spese rispettivamente anticipate e di compensare le ripetibili;
richiamati gli art. 351 e segg.CPC, nonchè la LTG,
decreta 1. La causa proposta direttamente in appello -inc. 10.2003.35- divenuta priva d’oggetto, é stralciata dai ruoli.
Le spese del presente giudizio con tassa di giustizia per complessivi fr. 150.-, già anticipati dall’attrice, restano a suo carico. Le ripetibili sono compensate.

Whether the appeal should be struck from the docket after an extrajudicial settlement
The appeal had become devoid of object and was struck from the docket.
After the parties notified the court that they had settled the dispute out of court, there was no longer a live controversy to decide.
Allocation of court costs and party costs after settlement
The court costs, including the justice fee of CHF 150 already advanced by the appellant, remained with the appellant; party costs were set off.
The parties had agreed that each would bear its own costs and that party costs would be compensated.
