The objector withdrew his opposition to a penal order by letter of 25 September 2003. The Pretura penale therefore struck the criminal proceeding from the docket and declared the penal order enforceable. The court also ordered the objector to pay CHF 50 in justice fees and CHF 30 in costs. The separated proceedings against another person were to continue with the adjourned hearing.
Art. 210-211 CPP; withdrawal of opposition to a penal order: upon valid withdrawal, the objection proceedings are discontinued and the penal order enters into force. The court may then strike the case from the roll and allocate the procedural costs to the objector according to the ordinary cost rules (consid. 1-3).

Effect of the withdrawal of the objection against the penal order
The criminal proceedings against the opponent were removed from the docket and the penal order became enforceable.
After the withdrawal of the objection, the court had to strike the case and let the penal order take effect under Arts. 210 and 211 CPP.
Allocation of court fees and costs after withdrawal of the objection
Court fees and costs of CHF 80 were charged to the objector.
The withdrawal of the objection justified charging the objector with the justice fee and procedural costs of the present decision.
