The defendant withdrew his opposition to an accusation decree in writing. The Pretura penale therefore struck the case from the rolls and held that the decree became enforceable. No court fee was levied, but the procedural costs of CHF 30 were charged to the objecting party.
Art. 210 cpv. 3 CPP; withdrawal of opposition to an accusation decree: upon written withdrawal of the opposition, the criminal court strikes the matter from the docket and the accusation decree attains enforceability. In such a procedural termination, the court may waive the justice fee while charging the costs of the decision to the objecting party, according to the circumstances of the case (consid. implicit).
