The Bellinzona criminal court noted that the objector had withdrawn the objection filed against a decree of accusation. Relying on Arts. 210 and 211 CPP, it struck the case from the roll and declared the decree of accusation enforceable. It also ordered that no justice fee be collected, while the procedural costs of CHF 30 were to be borne by the objector.
Art. 210-211 CPP; withdrawal of an objection against a decree of accusation: upon valid withdrawal, the objection proceedings are struck from the roll and the decree of accusation becomes enforceable. The court may then determine the allocation of procedural costs; a waiver of the justice fee does not preclude charging remaining costs to the withdrawing objector (consid. 1-2).
