The accused withdrew, through counsel, his objection to the penal decree issued by the public prosecutor. The Pretura penale therefore struck the matter from the docket, declared the decree enforceable, and cancelled the public hearing previously set for 7 August 2003. The file was returned to the prosecutor for any further steps within his competence. The court ordered that no justice fee or expenses be levied.
Art. 210 cpv. 3 CPP; withdrawal of an objection to a criminal order of penalty; upon valid withdrawal, the proceedings are struck out, the penal order becomes enforceable, and the scheduled hearing falls away. Where the court so provides, no court costs or justice fee are charged.
