An accused person lodged an opposition to a criminal accusation decree but withdrew it on 2003-05-07. The Pretura penale, acting through President Marco Kraushaar, therefore struck the proceedings from the docket and declared the accusation decree enforceable. The court waived the justice fee but imposed the procedural costs of CHF 30 on the objector.
Art. 210–211 CPP; withdrawal of opposition against a criminal decree of accusation: upon valid withdrawal, the objection proceedings are to be removed from the docket and the decree of accusation becomes enforceable.
