The Ticino Pretura penale dealt with an objection to a criminal decree of accusation. After the complaint was withdrawn, the judge ordered the case struck from the roll and returned the file to the Public Prosecutor for any further action. Court fees of CHF 30 and expenses of CHF 30 were imposed on the complainants, to be borne equally.
Art. 31 CPS; withdrawal of complaint and termination of proceedings: where the complaint is withdrawn, the criminal proceedings must be discontinued and struck from the roll. The court may return the file to the Public Prosecutor for any residual competence. Costs may be charged to the complainants in accordance with the applicable cost rules.
