The Bellinzona Pretura penale noted that the accused had withdrawn his objection to the criminal decree of accusation. The judge therefore struck the proceedings from the docket, declared the decree enforceable, cancelled the already scheduled public hearing, and returned the file to the public prosecutor. Court costs, including a justice fee of CHF 50 and judicial expenses, were charged to the objector.
Art. 210-211 CPP; withdrawal of an objection to a decree of accusation terminates the opposition proceedings and renders the decree enforceable. In such a case the court may strike the matter from the docket, cancel any scheduled hearing, and allocate the procedural costs to the objecting party.

Effect of the withdrawal of the objection to the decree of accusation
The proceedings were struck off the docket and the decree of accusation became enforceable.
Once the objection was withdrawn, there was no longer a pending dispute to be heard, so the scheduled public hearing had to be cancelled and the file returned to the public prosecutor.
