The Ticino Pretura penale noted that the opponent had withdrawn the objection to the criminal order by letter of 20 March 2003. On that basis, and relying on Arts. 210 and 211 CPP, the court struck the case from the docket and declared the criminal order enforceable. No court fee was levied, but the procedural costs of CHF 30 were imposed on the opponent. The decision was issued by President Marco Kraushaar.

Where an objection against a criminal order is withdrawn, the court must strike the proceedings from the docket and the order attains enforceability. The procedural extinction follows directly from the withdrawal and does not require a substantive review of the order.
