The opponent withdrew the opposition to a criminal decree by letter of 10 June 2003. The Pretura penale of Bellinzona therefore struck the proceedings from the roll, cancelled the scheduled public hearing, and declared the decree d’accusa final and enforceable. The court also ordered the opponent to pay a justice fee of CHF 50 and court costs of CHF 30, for a total of CHF 80.
Art. 210-211 CPP; withdrawal of opposition to a decree d’accusa and procedural consequences; upon valid withdrawal of the opposition, the objection proceedings are discontinued, the scheduled debate falls away, and the decree d’accusa becomes enforceable. The costs of the termination may be charged to the opponent who withdraws the objection.
