The Ticino Pretura penale noted that the accused withdrew the opposition filed against a summary penalty order. On that basis, the judge struck the case from the docket, cancelled the already scheduled public hearing, and sent the file back to the public prosecutor for further action within his competence. The court also ordered the opponent to pay CHF 50 in court fees and CHF 50 in expenses.
Art. 210 cpv. 3 CPP; withdrawal of opposition against a decree d'accusa. If the accused withdraws the opposition, the objection proceedings are terminated, the case is struck from the roll, and the summary penalty order acquires enforceability. The already fixed public hearing becomes moot. Procedural costs occasioned by the order may be charged to the objecting party (consid. 1-3).
