The opponent withdrew the objection previously filed against a decree of accusation. The Pretura penale therefore struck the matter from the docket, declared the decree enforceable, cancelled the public hearing scheduled for 26 March 2004, and returned the file to the public prosecutor for any further action within his competence. The opponent was ordered to pay CHF 50 in court fees and CHF 30 in expenses.
Art. 210-211 CPP; effect of withdrawal of opposition to a decree of accusation: if the objection is withdrawn before the public hearing, the court must strike the proceedings from the roll and the decree of accusation becomes enforceable. The hearing becomes moot and the file is returned to the prosecuting authority for the continuation of the case as required. Procedural costs may be charged to the objecting party; the court need only note the withdrawal and does not adjudicate the merits (consid. implicit).

richiamata l'opposizione dell'8 ottobre 2002 di
(difeso dal)
interposta al decreto d’accusa DAP / di data __________ 2002 del PP Garzoni,
preso atto del ritiro della suddetta opposizione con dichiarazione del 24 marzo 2004,
visti gli art. 210 e 211 CPP,
decreta: 1. Il procedimento è stralciato dai ruoli e il decreto d'accusa è esecutivo.
Il pubblico dibattimento, già fissato per il 26 marzo 2004 alle ore 09:00 non avrà quindi luogo; l'incarto è ritornato al PP per quanto di sua competenza.
La tassa di giustizia di fr. 50.– e le spese di fr. 30.– relative alla presente decisione sono a carico dell'opponente.
