The defendant had lodged opposition to a criminal decree of accusation. At the hearing, defense counsel withdrew the opposition. The Pretura penale accordingly struck the case from the roll, declared the decree of accusation enforceable, and returned the file to the prosecutor for further steps within his competence. The court also ordered that no court fees or costs be charged.

Where the accused, through counsel, withdraws the opposition during the hearing, the criminal court must strike the proceedings from the roll and the decree of accusation becomes final and enforceable. In such a procedural termination, the court may order that no taxes or costs be levied (consid. implicit).
