The accused had lodged an opposition to a decree of accusation issued by the public prosecutor. At the hearing before the Pretura penale, the accused withdrew the opposition. The single judge therefore struck the case from the docket, declared the decree of accusation enforceable, and ordered that no fees or costs be charged. The file was returned to the public prosecutor for further action within its competence.
Arts. 210 and 211 CPP; withdrawal of opposition against a decree of accusation: once the opposition is validly withdrawn during the objection hearing, the objection proceedings are terminated, the case is struck from the docket, and the decree of accusation acquires enforceability. In the absence of further issues, no costs are imposed (consid. implicit).
