The accused withdrew the objection to a decree of accusation during the hearing before the Pretura penale. The judge therefore struck the case from the docket, declared the decree enforceable, and ordered that no court fees or costs be charged. The file was returned to the public prosecutor for any further action within his competence.
Art. 210-211 CPP; withdrawal of the objection to a decree of accusation: when the objection is withdrawn during the hearing, the objection proceedings are discontinued, the case is removed from the docket, and the decree of accusation acquires enforceability. In such circumstances, the court may order that no costs be levied (consid. 1-2).
