In a direct appeal concerning contractual liability, the parties informed the Court of Appeal that they had reached a settlement and jointly requested that the case be removed from the docket. It ordered the procedural costs, totaling CHF 41,500, to be borne by the plaintiff, who had advanced them, and offset the compensatory allowances (ripetibili).

CV 1 (rappr. dall’ RA 1)
con la quale l’attrice ha chiesto la condanna della convenuta al pagamento dell’importo di Fr. 11'121'913.- oltre interessi al 5% dal 7 gennaio 2002 in materia di responsabilità contrattuale (mandato di revisione interna).
Ed ora sullo stralcio della causa, così come concordemente richiesto dalle parti con lettera 9 giugno 2005, essendo intervenuto tra le stesse un accordo transattivo che regola pure il destino delle spese giudiziarie nel senso di caricarle alla parte attrice, che le ha anticipate, con compensazione dell’indennità ripetibile.
Ritenuto che la tassa e le spese di giudizio vengono commisurate al valore di causa ed agli atti di procedura svolti sino ad oggi.
Vista per le spese la vigente TG
decreta 1. La causa inc. 10.2002.1 di questo Tribunale, di cui alla petizione 7 gennaio 2002 promossa da AT 1 contro CV 1, è stralciata dai ruoli per transazione.
