The Second Civil Chamber of the Ticino Court of Appeal dealt with a civil appeal for CHF 1,306,600. After one defendant had already been removed from the litigation and others had filed responses, the plaintiffs’ lawyer notified the court that the petition was being withdrawn because the matter had been settled out of court. The court took note of the written settlement signed by counsel and ordered the case struck from the roll. It also allocated the total court charges of CHF 500 to one party and ordered party costs to be compensated.
Art. 148 and 352 CPC; withdrawal of action or appeal after extrajudicial settlement: where the claimant withdraws the proceeding and the court is informed of a settlement regulating also the procedural monetary consequences, the court strikes the case from the roll. Procedural costs are allocated in accordance with the parties’ agreement or, failing that, under the applicable cost rules; party costs may be compensated. The settlement need not be reproduced in detail if the written agreement, signed by counsel, sufficiently establishes the withdrawal and the agreed cost arrangement (consid. implicit).
