§§ 80 ff. aZPO (TG)


1. Gemäss RBOG 1994 Nr. 24 ist das Gerichtspräsidium verpflichtet, die Verhältnisse der um Gewährung der unentgeltlichen Prozessführung ersuchenden Partei abzuklären und sie zur Mitwirkung anzuhalten. Es ist ihr Gelegenheit zu geben, die für die Beurteilung ihres Antrags erforderlichen Belege, insbesondere eine Berechnung ihres sozialen Existenzminimums, einzureichen; allenfalls ist sie zur Edition von Urkunden, welche über ihre Einkommens- und Vermögensverhältnisse Aufschluss geben (Steuererklärungen und -rechnungen, Buchhaltung etc.), anzuhalten und nötigenfalls einzuvernehmen.

2. Im zweitinstanzlichen Verfahren gelten diese Grundsätze nicht mehr ohne weiteres. Zwar findet auch im Rekursverfahren die Offizialmaxime unbeschränkt Anwendung, weshalb neu erhobene Tatsachenbehauptungen und auch erst nach Ablauf der Rechtsmittelfrist eingelegte Beweismittel zu berücksichtigen sind (Ries, Die unentgeltliche Rechtspflege nach der aargauischen Zivilprozessordnung, Diss. Zürich 1990, S. 145). Hingegen trifft den zweitinstanzlichen Richter nicht dieselbe Pflicht wie die Vorinstanz, den Verhältnissen von Amtes wegen nachzugehen: Kann die erneut um Bewilligung der unentgeltlichen Prozessführung nachsuchende Partei dem angefochtenen Entscheid klar entnehmen, dass es dem erstinstanzlichen Begehren an der notwendigen Begründung fehlte, dass sie folglich nunmehr aussagekräftige Angaben und Unterlagen über ihre Einkommens- und Vermögensverhältnisse einreichen muss, ist die Rechtsmittelbehörde nicht mehr gehalten, sie an ihre Mitwirkungspflichten zu erinnern und ihr nochmals eine Nachfrist anzusetzen. Vielmehr gehört es in solchen Fällen zur genügenden Begründung des Rekurses im Sinn von § 238 Abs. 2 ZPO, die vor Vorinstanz nicht vorgebrachten Tatsachen mindestens glaubhaft zu machen (vgl. RBOG 1992 Nr. 36).
