The defendant appealed a March District Court judgment but withdrew the appeal before the appellate court dealt with the merits. The Schwyz Cantonal Court therefore struck the appeal off the docket in a presidential order and allocated the second-instance court costs of CHF 300 to the State. The order also stated the further recourse available to the parties before the Federal Supreme Court.

(Berufung gegen das Urteil des Bezirksgerichts March vom 5. Mai 2020, SGO 2019 18);-
hat die Kantonsgerichtsvizepräsidentin,
nachdem sich ergeben und in Erwägung:
dass der Beschuldigte gegen das Urteil des Bezirksgerichts March vom 5. Mai 2020 innert Frist am 22. Mai 2020 Berufung anmeldete (KG-act. 2; Art. 399 Abs. 1 StPO);
dass das begründete Urteil am 19. August 2020 zum Versand kam;
dass der Beschuldigte mit Schreiben vom 4. September 2020 den Rückzug der angemeldeten Berufung mitteilen liess (KG-act. 3/0);
dass somit infolge Rückzugs der angemeldeten Berufung die Berufung praxisgemäss im Verfahren nach § 40 Abs. 2 i.V.m. § 41 Abs. 1 JG präsidial abzuschreiben ist (Art. 386 StPO; STK 2012 22 vom 7. Mai 2012);
dass die Gerichtskosten der zweiten Instanz bei diesem Ausgang zu Lasten des Staates gehen;-
verfügt:
1. Die Berufung wird infolge Rückzugs abgeschrieben.
2. Die zweitinstanzlichen Gerichtskosten von Fr. 300.00 gehen zu Lasten des Staates.
3. Gegen diesen Entscheid kann innert 30 Tagen seit Zustellung nach Massgabe von Art. 78 ff. des Bundesgerichtsgesetzes *Beschwerde in Strafsachen * beim Bundesgericht in Lausanne eingereicht werden. Die Beschwerdeschrift muss den Anforderungen von Art. 42 BGG entsprechen.
4. Zufertigung an Rechtsanwalt B.________ (2/R, unter Beilage von
KG-act. 3 in Kopie) sowie an die Oberstaatsanwaltschaft (1/R), die Staatsanwaltschaft March (1/A) und an die Privatkläger (je 1/R), je mit Kopie von KG-act. 3 und 3/0 sowie an die Vorinstanz (1/A) und nach definitiver Erledigung an die Vorinstanz (1/R, unter Rückgabe der Akten und zum Vollzug inkl. Mitteilungen gemäss Dispositivziff. 16 des vorinstanzlichen Urteils) und an die Kantonsgerichtskasse (1/ü, im Dispositiv).
