The Schwyz Cantonal Court noted that the prosecution had timely announced an appeal against the judgment of the District Court of Höfe, but later withdrew the appeal by letter. The vice-president therefore ordered the appeal proceedings closed as withdrawn. Second-instance court costs of CHF 300 were imposed on the State. The decision also informs the parties of the possibility of a criminal-law appeal to the Federal Supreme Court.

The order is rendered by the president or vice-president in summary form; the ordinary remedy to the Federal Supreme Court remains reserved under the BGG.

(Berufung gegen das Urteil des Bezirksgerichts Höfe vom 28. Mai 2018, SEO 2018 6);-
hat der Kantonsgerichtsvizepräsident,
nachdem sich ergeben und in Erwägung:
dass die Staatsanwaltschaft Höfe Einsiedeln gegen das Urteil des Bezirksgerichts Höfe vom 28. Mai 2018 innert Frist am 8. Juni 2018 Berufung anmeldete (Art. 399 Abs. 1 StPO; KG-act. 2);
dass das begründete Urteil am 27. Juni 2018 zum Versand kam;
dass die Staatsanwaltschaft Höfe Einsiedeln mit Schreiben vom 2. Juli 2018 dem Kantonsgericht den Rückzug der angemeldeten Berufung bekanntgab (KG-act. 3);
dass demnach das Verfahren zufolge Rückzugs der Berufung nach § 40 Abs. 2 i.V.m. § 41 Abs. 1 JG präsidial abzuschreiben ist;
dass die Gerichtskosten der zweiten Instanz bei diesem Ausgang zu Lasten des Staates gehen;-
verfügt:
1. Die Berufung wird als durch Rückzug erledigt abgeschrieben.
2. Die zweitinstanzlichen Gerichtskosten von Fr. 300.00 gehen zu Lasten des Staates.
3. Gegen diesen Entscheid kann innert 30 Tagen seit Zustellung nach Massgabe von Art. 78 ff. des Bundesgerichtsgesetzes *Beschwerde in Strafsachen * beim Bundesgericht in Lausanne eingereicht werden. Die Beschwerdeschrift muss den Anforderungen von Art. 42 BGG entsprechen.
4. Zufertigung an die Staatsanwaltschaft Höfe Einsiedeln (1/A), die Oberstaatsanwaltschaft (1/R), Rechtsanwalt C.________ (2/R, inkl. Doppel KG-act. 3), die Vorinstanz (1/A) sowie nach definitiver Erledigung an die Vorinstanz (1/R, unter Rückgabe der Akten; zur Erstattung der Meldungen an das Verkehrsamt und an die KOST) und an die Kantonsgerichtskasse (1/ü, im Dispositiv).
