The Schwyz Cantonal Court, sitting through its president, noted that the cantonal prosecution had timely announced an appeal against the criminal court judgment but later informed the court that it would not maintain the appeal and was withdrawing it. The court therefore discontinued the appellate proceedings. It ordered the second-instance court costs of CHF 300 to be borne by the State and informed the parties of the possibility of a criminal-law complaint to the Federal Supreme Court.
Art. 399 Abs. 1 StPO; § 40 Abs. 2 JG; withdrawal of the notice of appeal; where the appellant expressly renounces the announced appeal before pursuing it, the appellate proceedings are discontinued ex officio and without substantive review. The withdrawal leads to administrative closing of the case; the appellate court costs are allocated according to the cantonal cost rule applicable to such termination. The matter does not require any examination of the merits of the appealed judgment (consid. 1–2).

(Berufung gegen das Urteil des Strafgerichts vom 27. April 2017, SGO 2016 23);-
hat der Kantonsgerichtspräsident,
nachdem sich ergeben und in Erwägung:
dass die kantonale Staatsanwaltschaft gegen das Urteil des Strafgerichts vom 27. April 2017 innert Frist am 3. Mai 2017 mit Zustimmung der Oberstaatsanwaltschaft Berufung angemeldet hat (Art. 399 Abs. 1 StPO);
dass das begründete Urteil am 8. August 2017 zum Versand gekommen ist;
dass die kantonale Staatsanwaltschaft mit Schreiben vom 29. August 2017 dem Kantonsgericht mitteilt, an der angemeldeten Berufung nicht festzuhalten bzw. auf die Berufung zu verzichten und damit den Rückzug der angemeldeten Berufung bekannt gegeben hat;
dass demnach das Verfahren zufolge Rückzugs der Berufungsanmeldung präsidial nach § 40 Abs. 2 JG abzuschreiben ist;
dass die Gerichtskosten der zweiten Instanz bei diesem Ausgang zu Lasten des Staates gehen;-
verfügt:
1. Die Berufung wird als durch Rückzug der Berufungsanmeldung erledigt abgeschrieben.
2. Die zweitinstanzlichen Gerichtskosten von Fr. 300.00 gehen zu Lasten des Staates.
3. Gegen diesen Entscheid kann innert 30 Tagen seit Zustellung nach Massgabe von Art. 78 ff. des Bundesgerichtsgesetzes *Beschwerde in Strafsachen * beim Bundesgericht in Lausanne eingereicht werden. Die Beschwerdeschrift muss den Anforderungen von Art. 42 BGG entsprechen.
4. Zufertigung an die kantonale Staatsanwaltschaft (1/A), die Oberstaatsanwaltschaft (1/R), Rechtsanwalt C.________ (2/R), die Vorinstanz (1/ü) sowie nach definitiver Erledigung an die Vorinstanz (1/ES, unter Rückgabe der Akten; zum Vollzug und zur Erstattung der Meldungen, inkl. Meldung an die KOST) und an die Kantonsgerichtskasse (1/ü, im Dispositiv).

The appeal was discontinued and struck from the docket because the prosecution withdrew the notice of appeal.
Once the prosecution notified the court that it would not pursue the announced appeal and expressly withdrew it, the proceedings had to be closed administratively under the applicable cantonal rule.
