The Schwyz Cantonal Court dealt with a prosecution appeal against a district court judgment concerning usurpation of office, alternatively abuse of authority. After the appellate submission had been filed in time and the reasoned judgment had been sent to the parties, the prosecuting authority notified the court that it was withdrawing the appeal. The vice-president therefore discontinued the appeal proceedings and ordered the second-instance costs of CHF 300 to be borne by the state.
Art. 399 Abs. 1 StPO; § 40 Abs. 2 JG; withdrawal of an announced appeal and allocation of costs. Where the appellant withdraws a duly announced appeal before appellate adjudication, the appellate proceedings are to be struck off as moot by reason of withdrawal. In such a case, the second-instance court costs are, according to practice, borne by the state. The dispositive effect is limited to procedural termination and costs; the merits of the lower-court judgment are not examined (consid. 1-2).

(Berufung gegen das Urteil des Bezirksgerichts Schwyz vom 27. April 2017, SGO 2016 4);-
hat der Vizepräsident,
nachdem sich ergeben und in Erwägung:
dass a.o. Oberstaatsanwalt A.________ gegen das im Dispositiv eröffnete Urteil des Bezirksgerichts Schwyz vom 27. April 2017 innert Frist Berufung angemeldet hat (Art. 399 Abs. 1 StPO);
dass das begründete Urteil am 18. Juli 2017 an die Parteien versandt wurde;
dass a.o. Oberstaatsanwalt A.________ mit Schreiben vom 2. August 2017 dem Kantonsgericht den Rückzug der Berufung bekannt gegeben hat;
dass demnach das Verfahren zufolge Rückzugs der angemeldeten Berufung praxisgemäss präsidial nach § 40 Abs. 2 JG abzuschreiben ist;
dass die Gerichtskosten der zweiten Instanz bei diesem Ausgang zu Lasten des Staates gehen;-
verfügt:
1. Die Berufung wird als durch Rückzug der angemeldeten Berufung erledigt abgeschrieben.
2. Die zweitinstanzlichen Gerichtskosten von Fr. 300.00 gehen zu Lasten des Staates.
3. Gegen diesen Entscheid kann innert 30 Tagen seit Zustellung nach Massgabe von Art. 78 ff. des Bundesgerichtsgesetzes *Beschwerde in Strafsachen * beim Bundesgericht in Lausanne eingereicht werden. Die Beschwerdeschrift muss den Anforderungen von Art. 42 BGG entsprechen.
4. Zufertigung an Rechtsanwalt E.________ (2/R; unter Beilage des Schreibens vom 2. August 2017), a.o. Oberstaatsanwalt A.________ (1/R) und an die Vorinstanz (1/A) sowie nach definitiver Erledigung an die Vorinstanz (1/R, unter Rückgabe der Akten) und an die Kantonsgerichtskasse (1/ü, im Dispositiv).
