Gemäss Art. 178 ZGB sind Verfügungsbeschränkungen zulässig. Die Ehefrau verlangt eine Grundbuchsperre über die dem Ehemann gehörende Liegenschaft GB Z. Nr. 1998. Es ist erwiesen, dass der Ehemann seit 10 Monaten seine Alimentenverpflichtung nicht erfüllt - gemäss Art. 145 ZGB Fr. 2'200 monatlich. Er bezahlt keinen Franken freiwillig und muss betrieben werden. Dabei erhebt er grundlos Rechtsvorschlag und behauptet tatsachenwidrig, sein Wohnsitz befinde sich bei seinem Vater in M. Seine Söhne hat er ausgesperrt, er bezahlt auch ihnen keinen Unterhalt, sie mussten Klage beim zuständigen Zivilgericht erheben. Das Oberamt stellte wegen Vernachlässigung von Unterstützungspflichten Strafantrag. Zudem haben die Söhne der Ehefrau berichtet, der Ehemann wolle sich möglicherweise mit seinem "Anwalt" W. nach Australien absetzen. Das ist nicht unmöglich, ist doch gerichtsnotorisch, dass dieser längere Zeit dort weilte. Unter diesen Umständen ist die Gefährdung sowohl der Alimentenverpflichtung wie der güterrechtlichen Ansprüche mehr als glaubhaft gemacht. Dem Ehemann ist daher antragsgemäss zu verbieten, ohne Zustimmung von Frau P. über das Grundstück GB Z Nr. 1998 zu verfügen.
