§ 303 ZPO expressly regulates noven only for summary-procedure appeals and, by contrast, does not exclude them for other appeal types. Procedural orders are different because they do not enter into material res judicata and the appellate court should review only what was before the lower court. Cost decisions are not procedural orders, and the appellate court has unrestricted cognition under § 300(2) ZPO; therefore there is no reason to bar noven.
