Nach § 149 lit. a des Gemeindegesetzes ist gegenüber Gemeindebeamten, die vom Volk an der Urne gewählt werden (so also auch gegenüber dem Gemeindeschreiber), die Gemeindeversammlung eigentliche Disziplinarbehörde. Nicht sie, sondern der Gemeinderat ist aber in solchen Fällen nach § 26 Abs. 2 Satz 2 des Verantwortlichkeitsgesetzes zur Einleitung des Disziplinarverfahrens zuständig. Es erscheint richtig, die Ordnung von § 26 Abs. 2 Satz 2 auch auf die Zuständigkeit für Massnahmen nach § 25 Abs. 5 anzuwenden.
