The Obergericht’s civil chamber considered the wife’s request that her husband advance her divorce litigation costs. It held that such an advance depends on the spouses’ mutual duty of support, the requesting spouse’s need for assistance, and the other spouse’s ability to pay. Although the husband could afford payment, the wife earned CHF 4,330 per month and could finance her own legal costs. The request was therefore denied.

Art. 145 in conjunction with Art. 159 Abs. 3 ZGB; process cost advance in divorce proceedings: the spouse claiming an advance must be in genuine need of support for financing the lawsuit, while the other spouse must have the means to provide it. The court exercises free discretion in assessing these prerequisites. No entitlement exists where the requesting spouse can, without impairing reasonable subsistence, procure the necessary funds from own income or assets within a useful time and thereby meet the attorney’s costs independently (consid. cited in the reasons).

* Obergericht Zivilkammer, Urteil vom 15. November 1977*

Questione giuridica chiave

Whether the husband had to pay a process cost advance for the wife's divorce proceedings.

Decisione estratta

A process cost advance was denied because, although the husband could pay, the wife was not in need of support and could finance her own legal costs from her income.

Motivazione estratta

The duty to advance litigation costs follows from the spouses' mutual duty of support. It exists only if the claim is not manifestly hopeless or abusive, the requesting spouse needs support to fund the proceedings, and the other spouse is able to pay. Here, the wife earned enough to cover her own attorney’s fees without affecting her reasonable living needs.
