Das Verfahren kann im Appellationsstadium nicht mehr ausgedehnt werden, da der Beschuldigte die Gewissheit haben muss, dass im Appellationsverfahren nur die bereits vor erster Instanz abgesprochenen Sachverhalte beurteilt werden. Dem Beschuldigten muss die Anschuldigung im erstinstanzlichen Verfahren in allen Teilen vorgehalten werden. Die Appellationsinstanz kann keine neuen, dem Beschuldigten erst in appellatorio zur Last gelegten Sachverhalte oder Sachverhaltselemente beurteilen oder gar untersuchen. Daraus ergibt sich, dass in tatbeständlicher Hinsicht die Schlussverfügung, eventuell ergänzt durch Einstellungs- oder Ausdehnungsbeschlüsse des Amtsgerichtes, den Gegenstand der Urteilsfindung für das Obergericht genau und abschliessend umschreibt (vgl. RB 1973 Nr. 21 und 1963 Nr. 22). Dem Staatsanwalt ist es jedoch unbenommen, bezüglich nicht beurteilter Sachverhalte Strafanzeige zu erstatten. Nicht eingeschränkt ist das Obergericht hingegen in der strafrechtlichen Würdigung einer Tat, und es steht ihm frei, einen Sachverhalt anders als in der Schlussverfügung und von der Vorinstanz abweichend zu beurteilen (§ 116 StPO). * Obergericht Strafkammer, Urteil vom 8.
