SOG 1975 Nr. 17 ** Art. 41 Ziff. 1 StGB; § 139 Abs. 2 StPO.*Auch im Abwesenheitsverfahren ist der bedingte Strafvollzug zu gewähren, wenn die Voraussetzungen nach Art. 41 StGB erfüllt sind. Die Vorinstanz hat dem Beschuldigten unter Hinweis auf die "feststehende Praxis bei Abwesenheitsverfahren" den bedingten Strafvollzug verweigert. Dem kann nicht zugestimmt werden. Gemäss § 139 Abs. 2 StPO hat der abwesende Beschuldigte ein Anrecht darauf, dass die Untersuchung gegen ihn mit gleicher Gründlichkeit wie gegen einen Anwesenden geführt wird. Dieser Grundsatz muss auch bei der Urteilsfällung Anwendung finden. Wenn also die Voraussetzungen von Art. 41 Ziff. 1 StGB erfüllt sind, muss dem Beschuldigten auch im Kontumazverfahren die Rechtswohltat einer bedingten Strafe zugestanden werden. Der Beschuldigte G. geniesst sowohl persönlich wie beruflich einen ausgezeichneten Leumund und ist in der Schweiz nicht vorbestraft. Es wäre ungerecht, würde man hier mit ungleichen Ellen messen und eine bedingte Strafe nur deshalb verweigern, weil er bei der Verhandlung (zu der er persönlich gar nicht vorgeladen werden konnte) nicht anwesend war. Im vorliegenden Falle wäre dies auch deshalb stossend, weil der Beschuldigte die Schweiz nicht verliess, um sich dem Strafvollzug zu entziehen, wurde doch das Strafverfahren gegen ihn erst fünf Monate nach seiner Abreise eröffnet. * Obergericht Strafkammer, Urteil vom 24.
