St. hatte im Landwirtschaftsbetrieb des X. zwei Pferde eingestellt. Da sie das Winterungs- und Sömmerungsgeld nicht rechtzeitig leistete und zudem das eine Pferd wegnahm, stellte X. beim Betreibungsamt das Begehren um Aufnahme einer Retentionsurkunde für das Pferd, das sich noch bei ihm befand. Das Betreibungsamt stellte eine entsprechende Retentionsurkunde aus. Frl. St. erhob dagegen bei der kantonalen Aufsichtsbehörde über Schuldbetreibung und Konkurs Beschwerde mit der Behauptung, das Retentionsverfahren nach Art. 283 SchKG sei für den betreffenden Fall nicht anwendbar. Das Betreibungsamt erklärte in seiner Vernehmlassung, es stehe eine Viehpacht nach Art. 302 OR zur Diskussion, auf welche die Bestimmungen über die Pacht, insbesondere auch diejenige über das Retentionsrecht nach Art. 286 OR Anwendung fänden. Die Aufsichtsbehörde hat dazu folgendes erwogen: Im vorliegenden Verfahren geht es nicht um die Frage, ob dem Gläubiger ein Retentionsrecht zustehe, sondern darum, ob das Verfahren nach Art. 282 ff. SchKG anwendbar sei und deshalb die Aufnahme des Retentionsverzeichnisses mit den Folgen des Art. 284 SchKG zu Recht erfolgt sei. Die in Art. 283 SchKG geregelte Wahrung des Retentionsrechtes nach Art. 272-274 und 286 OR gilt nur für den Vermieter, resp. Verpächter von unbeweglichen Sachen, weil dieser nicht im Besitz der ins Mietobjekt (Pachtobjekt) eingebrachten Gegenstände ist. Der Gläubiger - mit der Beschwerdeführerin in keinem Miet- oder Pachtverhältnis stehend - ist zudem selber im Besitz einer der Schuldnerin gehörenden beweglichen Sache, weshalb sich die Wahrung seines allfälligen Retentionsrechtes erübrigt. Das dem Gläubiger eventuell zustehende Retentionsrecht ist eines nach Art. 895 ZGB. Das Verfahren nach Art. 283 SchKG ist auf Retentionsrechte nach Art. 895 ZGB aber nicht anwendbar (vgl.
