The defendant appealed a first-instance criminal judgment. The prosecution had filed a cross-appeal on sentence severity, but at the appellate hearing it only requested confirmation of the judgment. The court held that this amounted to an implicit withdrawal of the cross-appeal. Because no valid cross-appeal seeking an aggravation remained, the defendant's position could not be worsened on appeal under Art. 391(2) StPO.

Art. 386 Abs. 2 lit. a, Art. 391 Abs. 2 StPO; implicit withdrawal of a cross-appeal and prohibition of reformatio in peius. A cross-appeal by the prosecution or private prosecutor has the function of removing the appellate prohibition against worsening the defendant's position only insofar as the cross-appellant continues to seek a modification of the challenged judgment to the defendant's detriment. If, in the appellate hearing, the cross-appellant confines itself to requesting confirmation of the first-instance judgment, this is to be construed as an implied withdrawal of the cross-appeal. In such a case, only the defendant's appeal remains pending, so the appellate court is barred from modifying the judgment to the defendant's detriment (consid. 4).

Art. 386 Abs. 2 lit. a und Art. 391 Abs. 2 ** StPO**. * Obergericht Strafkammer, Urteil vom 16. April 2015 (STBER.2014.15)*

Questione giuridica chiave

Whether the prosecution's cross-appeal was implicitly withdrawn when it requested confirmation at the appeal hearing.

Decisione estratta

Yes. By no longer requesting a worsening of the first-instance judgment and instead seeking full confirmation, the prosecution implicitly withdrew its cross-appeal.

Motivazione estratta

A cross-appeal can lift the prohibition against reformatio in peius only if the cross-appellant still seeks an amendment of the challenged judgment. If, at the hearing, the prosecution confines itself to asking for confirmation, that request is incompatible with a cross-appeal to the defendant's detriment and must be treated as an implied withdrawal.

Questione giuridica chiave

Whether the first-instance judgment could be amended to the defendant's detriment despite the cross-appeal declaration.

Decisione estratta

No. Once the cross-appeal was deemed withdrawn, only the defendant's appeal remained, so the first-instance judgment could not be changed to his detriment.

Motivazione estratta

Under Art. 391(2) StPO, an appellate court may not worsen the position of the appealing defendant when no valid cross-appeal seeking aggravation remains.
