SOG 2004 Nr. 15 ** Art. 217 StGB.Stellt das Oberamt nicht im eigenen Namen, sondern im Namen der unterhaltsberechtigten Ehefrau Strafantrag wegen Vernachlässigung von Unterhaltspflichten, so ist dieser nur insoweit gültig, als die Ehefrau selber ein Antragsrecht hatte. * Aus den Erwägungen: 4. b) Die Vernachlässigung von Unterhaltspflichten ist nur auf Antrag hin strafbar. Im Kanton Solothurn ist dazu im Sinne von Art. 217 Abs. 2 des Strafgesetzbuches (StGB, SR 311.0) auch das Oberamt berechtigt. Vorliegend stellte das Oberamt den Strafantrag jedoch nicht im eigenen Namen, sondern explizit laut Vollmacht in Vertretung der Ehefrau des Beschuldigten. Da ihre Tochter X. zu dem Zeitpunkt jedoch bereits mündig war, hatte ihre Mutter keine Vertretungsmacht über X. Diese hätte die Vollmacht ebenfalls unterzeichnen oder selbständig Strafantrag stellen sollen. Der Beschuldigte wird deshalb vom Vorwurf der Vernachlässigung von Unterhaltspflichten zum Nachteil seiner Tochter X. freigesprochen. Der Strafantrag gilt demzufolge nur für die Unterhaltsbeiträge, die der Beschuldigte in der eingeklagten Zeit von März 1999 bis März 2001 für seine Ehefrau und die jüngere Tochter Y. zu bezahlen hatte. Ansonsten ist der Strafantrag frist- und formgerecht eingereicht worden und auch der Ausdehnungsantrag erfolgte formgerecht (SOG 1998, Nr. 22). Aber auch bei Letzterem stellt die inzwischen eingetretene Volljährigkeit von Y. ein Hindernis für die Strafverfolgung des Beschuldigten dar: Der Ausdehnungsantrag erfolgte am 4.12.2002, als Y. bereits 19 Jahre alt war, weshalb er sich nur auf die in der Zeit von April 2001 bis Dezember 2002 unbezahlt gebliebenen Frauenalimente beziehen kann. * Obergericht Strafkammer, Urteil vom 12.
