Die Anerkennung der kalifornischen Geburtsurkunde und des kalifornischen Urteils verletzen nach umfassender Interessenabwägung den schweizerischen Ordre public nicht. Die Männer haben die in der Schweizerischen Bundesverfassung sowie im Fortpflanzungsmedizingesetz verankerten Verbote der Leihmutterschaft und Eizellenspende umgangen, indem sie sich ihren Kinderwunsch mit Hilfe einer ausländischen Rechtsordnung erfüllten, welche keine solchen Verbote vorsieht. Damit haben sie sich zwar über die Wertvorstellungen des schweizerischen Verfassungsgebers hinweggesetzt. Faktisch aber besteht nach amerikanischem Recht das Kindesverhältnis zu den beiden Männern, nach schweizerischem Recht würde es indessen zur amerikanischen Leihmutter und deren Ehemann bestehen. Das Kind lebt aber bei seinen beiden "Vätern" in der Schweiz. Diese von den "Vätern" geschaffene Ausgangslage verlangt im Interesse des Kindeswohls und im Interesse einer einheitlichen und klaren Rechtslage eine Anerkennung des Kindesverhältnisses zu den beiden Männern.

Damit hat nach dem am 19. August 2014 gefällten und noch nicht rechtskräftigen Urteil des St. Galler Verwaltungsgerichtes auch dieses Kind im schweizerischen Register ein – allerdings aus zwei Männern bestehendes – Elternpaar.
