The Regierungsrat held that it was competent to decide by lot which related member must resign from the cantonal parliament under Art. 51 KV. The provision excludes closely related persons from serving simultaneously and requires a lottery if resignation must be determined. Since the Constitution does not designate the competent authority, and cantonal elections fall within cantonal matters, the Government Council as the canton’s highest executive authority was deemed competent, especially because the case affected two municipalities.

Der Regierungsrat ist für den Losentscheid über den verwandtschaftlich bedingten Rücktritt bei Kantonsratswahlen zuständig.

Nach Art. 51 KV dürfen dem Kantonsrat Personen, die verschwägert sind, nicht gleichzeitig angehören. Über den durch Verwandtschaft bedingten Rücktritt entscheidet nötigenfalls das Los.
Wer für den Losentscheid zuständig ist, wird nicht ausdrücklich bestimmt. Die Kantonsratswahlen sind kantonale Wahlen (Art. 24 AG). Der Regierungsrat ist die oberste vollziehende Behörde des Kantons. Im vorliegenden Fall handelt es sich zudem um eine Angelegenheit, die zwei verschiedene Gemeinden betrifft. Der Regierungsrat erachtet sich deshalb als für den Losentscheid zuständig.
