On 31 August 1971 the Government Council decided an appeal concerning building lines along municipal roads. It held that, under Art. 22 No. 1 BauG, the determination of building lines is exclusively for the municipality, and appellate interference is only possible in case of a legal violation. It further held that exceptions to the building-line regime should be granted only when a concrete building project exists, so that conditions can be imposed; abstract exceptions would undermine the purpose of building lines and the unity of setbacks along the same street.
Art. 22 Ziff. 1 BauG; building lines along municipal roads are a matter reserved to municipal autonomy, so that appellate correction by the Government Council is permissible only in the presence of a legal violation. Exceptions to building-line requirements may be granted only on the basis of a concrete building project, because only then can appropriate conditions and limitations be attached. Granting abstract exceptions would contradict the purpose of building lines and the principle of uniform building-line distances along the same street; a mere reduced building depth does not by itself establish an unreasonable hardship.

Einheitlichkeit der Baulinien. Ausnahmebewilligungen sind erst möglich, wenn ein konkretes Bauvorhaben vorliegt.

Die Festsetzung von Baulinien entlang von Gemeindestrassen ist gemäss Art. 22 Ziff. 1 BauG ausschliesslich Sache der Gemeinde. Der Regierungsrat könnte im Rekursverfahren nur dann korrigierend in diesen Autonomiebereich der Gemeinde eingreifen, wenn eine Rechtsverletzung vorliegen würde.
Abgesehen davon, dass selbst bei einer Bautiefe von nur 10 m ein Wohnhaus noch erstellt werden kann und deswegen nicht zum vornherein von einer unzumutbaren Härte gesprochen werden kann, ist es durchaus vertretbar und sogar dem Sinn von Art. 4 BauR entsprechend, dass erst bei Vorliegen eines konkreten Bauvorhabens eine Ausnahme erteilt wird, mit welcher dann auch Auflagen und Bedingungen verknüpft werden könnten. Vielmehr würde es gerade dem mit Baulinien angestrebten Zweck widersprechen, verschiedene Baulinienabstände ein- und derselben Strasse entlang festzulegen.
