VVGE 1971/75 Nr. 8 ΓÇó No duty to ask before election to a side office
VVGE 1971/75 Nr. 8Altro tribunale24 ott 1972Dismissed
The Regierungsrat dismissed a complaint against the election of the complainant to a municipal side office in the water-supply commission. It held that Art. 23 KV, governing compulsory office, does not create a legal duty to consult the candidate before the election; such prior inquiry is only a matter of courtesy. It further held that the exemption grounds in Art. 23(2) KV are exhaustive, so professional workload cannot justify refusal. The complainant could therefore not avoid the office.
Art. 23 KV; compulsory office for side offices; no duty to consult the person concerned before election. Prior inquiry before appointment is a matter of courtesy only and not a legal prerequisite to a valid election (consid. 1). The exemption grounds from compulsory office are exhaustively enumerated in Art. 23(2) KV; additional reasons, in particular occupational burden, cannot be read into the constitutional text by interpretation (consid. 2). The competence to amend or reinterpret the constitutional scheme lies with the legislature, not the Regierungsrat.

Art. 23 KV.
