The Regierungsrat held that a house demolished and rebuilt at another location is to be treated as a new building within the meaning of Art. 3 BauG and therefore requires a building permit. The decision emphasizes that if even less intrusive works such as alterations or repainting are permit-related, the substantially more significant change of location must a fortiori be examined and authorized, especially because setback rules, traffic safety, and landscape protection may be affected.
Art. 3 BauG; relocation of a building by demolition and reconstruction at another site requires a permit. A house moved to a different location is not materially distinguishable from a new building within the meaning of the provision. The permit requirement is justified a fortiori where even lesser interventions, such as alterations or changes in color, are already subject to authorization. The decisive considerations are the possible impact on building setbacks, traffic safety, and landscape protection (consid. 1).

Wird ein Haus abgerissen und an einem andern Ort wieder aufgestellt, handelt es sich um eine Neubaute, was gemäss Art. 3 BauG bewilligungspflichtig ist; ein Unterschied von diesem Tatbestand zu jenem der Verschiebung eines Hauses ist nicht ersichtlich. Nachdem auch z.B. der Umbau oder die Farbgebung schon bewilligungspflichtig sind, muss umso mehr der viel wesentlichere Eingriff der Standortsveränderung begutachtet und bewilligt werden, denn gerade dadurch können Bauabstände, Verkehrssicherheit und Landschaftsschutz - Hauptinhalte des Baugesetzes - berührt werden.
