Bei Patentverweigerung als polizeilicher Administrativmassnahme ist keine Begnadigung möglich.

Materiell sind die Darlegungen des Beschwerdeführers insofern unzutreffend, als die Nichterteilung des kantonalen Jagdpatentes durch die Polizeidirektion gleichgestellt wird der vom Strafgericht in den Fällen von Art. 58 des eidgenössischen Jagd- und Vogelschutz-Gesetzes (JVG) vom 10. Juni 1925 auszusprechenden Nebenstrafe des Ausschlusses von der Jagdberechtigung. Ausschluss von der Jagdberechtigung und Nichterteilung des kantonalen Jagdpatentes sind zwei völlig verschiedene Sachverhalte und deshalb auch mit andern Voraussetzungen verknüpft. Während der Ausschluss von der Jagdberechtigung eine typische Nebenstrafe ist - Art. 58 JVG verwendet ausdrücklich den Begriff Nebenstrafe - und demzufolge in Verbindung mit der Hauptstrafe vom Gericht ausgesprochen wird und Gültigkeit hat für die ganze Schweiz, was bedeutet, dass der Betroffene in keinem Kanton das Jagdrecht ausüben darf, ist die Nichterteilung des Jagdpatentes eine auf das kantonale Hoheitsgebiet beschränkte, von einer kantonalen Verwaltungsbehörde ausgesprochene Massnahme vorwiegend polizeilicher Natur. Der Kanton ist frei, die Voraussetzungen des Patenterwerbers festzusetzen. Im Kanton Obwalden sind diese Voraussetzungen in Art. 5 Abs. 1 der Jagdverordnung vom 4. April 1959 aufgezählt und decken sich, wie auch in andern Kantonen, in keiner Weise mit den für den Ausschluss der Jagdberechtigung notwendigen Voraussetzungen, die in Art. 58 JVG umschrieben sind.

Vorliegend wurde, wie dies aus dem Entscheid der Strafkommission eindeutig hervorgeht, die Nebenstrafe des Ausschlusses von der Jagdberechtigung nicht ausgesprochen, so dass es dem Beschwerdeführer an sich freigestellt ist, in einem andern Kanton die Jagdberechtigung durch den Erwerb des betreffenden Jagdpatentes auszuüben. Im Kanton Obwalden ist diese Möglichkeit dem Beschwerdeführer nicht mehr gegeben, weil er gemäss Art. 5 Bst. g der Jagdverordnung das Patent nicht erlangen kann.
