Stellungnahme des Regierungsrates vom 2. September 1971 (Nr. 559).

  1. In bezug auf das Verfahren bei der Beschlussfassung über das Budget und über Ausgaben ist die Unterscheidung zwischen Ausgaben, die dem ordentlichen Verkehr und solchen, die dem ausserordentlichen Verkehr zugerechnet werden, völlig unerheblich. Die Unterscheidung ist eine rein buchhalterische, nicht aber eine rechtliche.

  2. Entscheidend ist hingegen, ob eine Ausgabe eine gebundene oder eine frei bestimmbare sei. Als gebundene und dadurch dem Ausgabenreferendum entzogene Ausgaben sind solche zu betrachten, deren Umfang durch Gesetz bereits fixiert oder doch hinreichend bestimmt ist. Nur diese gebundenen Ausgaben sind dem Ausgabenreferendum entzogen. Der Volksabstimmung unterliegen alle frei bestimmbaren, die Ausgabenkompetenz des Gemeinderates übersteigenden Ausgaben, ungeachtet dessen, ob sie in der ordentlichen oder ausserordentlichen Rechnung verbucht werden.

  3. Das Budget beinhaltet sämtliche gebundenen sowie die frei bestimmbaren Ausgaben, die von der gemäss verfassungsmässiger Ausgabenkompetenz zuständigen Gemeindebehörde (Gemeinderat oder Gemeindeversammlung) bereits beschlossen sind.

Die Beschlussfassung über Ausgaben und die Beschlussfassung über die Budgetgenehmigung sind strikte auseinanderzuhalten. Will man also in der nämlichen Versammlung, in der man das Budget zur Genehmigung vorlegt, auch noch Ausgabenbeschlüsse fassen, die auch im Budget bereits figurieren, so muss vor der Budgetberatung eine "Flurbereinigung" stattfinden, d.h. es müssen die einzelnen Ausgaben, die nicht gebundene Ausgaben sind und die Ausgabenkompetenz des Gemeinderates übersteigen, einzeln und gesondert vom Traktandum Budget zur Abstimmung gebracht werden. Dies verlangt unmissverständlich auch Art. 8 des Gesetzes über das Abstimmungs- und Wahlverfahren in den Gemeinden, der besagt: "Die Gemeindeversammlung kann gültig nur über Geschäfte abstimmen, die auf ihrer Geschäftsliste deutlich angekündigt wurden". Dies hat den Sinn, dass der Stimmbürger bereits aus der Traktandenliste ersehen kann, über welche Ausgaben und über welche Anträge des Gemeinderates an der betreffenden Versammlung zu befinden sein wird. Budgetgenehmigungsbeschluss und Ausgabenbeschluss müssen klar auseinandergehalten werden. Diese Trennung ist nicht nur rechtlich geboten, sondern auch sachlich gerechtfertigt, weil es sich eben um zwei verschiedene Sachen handelt.

Werden Ausgaben, die vom Gemeinderat beantragt sind und auch bereits im Budgetantrag des Gemeinderates figurieren, in der der Budgetgenehmigung vorangehenden Abstimmung nicht bewilligt, so hat ein solcher Beschluss eine automatische Änderung des Budgets zur Folge. Es ginge nicht an, diese Ausgabe, die vom Volk nicht bewilligt wurde, im Budget zu belassen und mit der Budgetgenehmigung als vom Volk beschlossen zu betrachten.
