The Regierungsrat held that the cantons retain sovereignty over their state organization and legislative procedure. A federal statute may not regulate cantonal legislative procedure for a special subject. Under the cantonal constitution, the Kantonsrat is competent to issue implementing ordinances to federal law, and contributions for burdens imposed by federal legislation may be set by the Kantonsrat. However, if cantonal water-protection legislation creates rights, duties, or organizational structures beyond what is mandatorily required by federal law, a statute is necessary under Art. 65(2) KV.

Where the cantonal constitution entrusts the Kantonsrat with the issuance of ordinances implementing federal law, such ordinances may regulate only what is compulsorily required by the federal-law basis. If rights, duties, or organizational structures are created beyond that mandatory scope, the matter falls under the statutory reservation and must be enacted in the form of a statute (consid. 2).

Es gehört zu den grundlegenden Souveränitätsrechten der Kantone, dass sie ihre Staatsorganisation selbst bestimmen können. Dazu zählt insbesondere auch das Verfahren der Rechtsetzung im Kanton. Es wird daher als unzulässiger Eingriff des Bundes in das Staatsrecht des Kantons erachtet, wenn dieser in einem Bundesgesetz für ein Spezialgebiet das Rechtsetzungsverfahren der Kantone regelt. Auf der andern Seite sieht die Kantonsverfassung jedoch vor, dass der Kantonsrat zum Erlass von Vollziehungsverordnungen zu Bundesrecht zuständig ist (Art. 72 KV). Ferner kann der Kantonsrat aufgrund von Art. 44 KV Beitragsleistungen der Gemeinden für Lasten festsetzen, die dem Kanton durch Bundesgesetzgebung oder Konkordatsverpflichtungen überbunden werden. Wenn in der kantonalen Gewässerschutzgesetzgebung nur Rechte und Pflichten der natürlichen und juristischen Personen sowie die Organisation allgemeingültig festgelegt werden, insoweit diese aus dem Bundesrecht zwingend hervorgehen, kann dies demnach durch Verordnung des Kantonsrates geschehen. Sollten aber über den Bereich der bundesrechtlichen Rechtsgrundlage hinaus neue Rechte und Pflichten begründet oder Organisationen geschaffen werden, hätte dies in der Form eines Gesetzes zu geschehen (Art. 65 Abs. 2 KV).
