The publication concerns an administrative appeal in which the appellant requested a site inspection. The Government Council held that the competent appellate authority has discretion to determine the necessary evidence and must order a site inspection only where the facts cannot be clarified otherwise. Since no such necessity is shown, the request for a site inspection is not automatically granted.

Die Rekursinstanz ist nur dann zur Durchführung eines Augenscheines verpflichtet, wenn die Verhältnisse anders überhaupt nicht abgeklärt werden können.

Der Rekurrent beantragt die Durchführung eines Augenscheines. Welche Beweismittel zur Erhärtung der behaupteten Tatsachen wesentlich sind, entscheidet im Rahmen des massgeblichen Verfahrensrechtes die zuständige Behörde. Der Regierungsrat als zuständige Rekursinstanz ist nur dann zum Augenschein verpflichtet, wenn die Verhältnisse anders überhaupt nicht abgeklärt werden könnten (siehe Imboden Max: Schweizerische Verwaltungsrechtsprechung, Band II, 4. Aufl., Basel 1971, S. 620).

Whether the appellate authority must carry out a site inspection on request
The appellate authority is obliged to conduct a site inspection only if the facts cannot be clarified in any other way.
Within the applicable procedural law, the competent authority decides what evidence is necessary. A site inspection is required only as a last resort when the circumstances cannot otherwise be established.
