The Regierungsrat held that, under established cantonal administrative practice, an appeal filed with an incompetent cantonal authority must be forwarded ex officio to the competent instance. For timeliness purposes, the decisive date is the original filing date with the wrong authority. The publication contains this procedural rule in the context of administrative proceedings.
Administrative procedure; filing of an appeal with an incompetent authority; under settled cantonal practice, such a filing must be forwarded ex officio to the competent authority, and the date of filing before the wrong authority is deemed the date of lodging the appeal. This preserves timeliness despite the initial filing error.

Nach ständiger kantonaler Verwaltungspraxis wird jedoch ein Rekurs, der bei einer unzuständigen kantonalen Behörde eingereicht wird, von Amtes wegen an die zuständige Instanz weitergeleitet und es gilt der Zeitpunkt der Einreichung als Zeitpunkt der Rekurserhebung.
