The text states that the leasing of land is generally a private-law transaction, but agricultural land leasing is governed by the Land Tenancy Act and requires authorization for parcel-wise leasing. It further holds that, under § 41 of the Municipal Act and the corporation’s own regulations, the corporation council’s allocation of corporation land is a sovereign act. The council’s individual allocation decision therefore qualifies as an administrative decision under the Administrative Procedure Act and may be challenged by administrative complaint to the Regierungsrat.

Art. 30 Abs. 1 and Art. 31 LPG; § 41 Gemeindegesetz; §§ 2 Abs. 1, 4 Abs. 1, 6 Abs. 1b and 142 Abs. 1b VRG: parcel-wise lease of agricultural land is subject to authorization and may be approved only if a statutory ground is met. Corporation municipalities remain bound by the public-law limits governing the use of corporation property; where their organs allocate corporation land for lease, they act with sovereign effect. The individual allocation decision concerns rights and duties and constitutes a decision within the meaning of the VRG, hence is appealable by administrative complaint to the Regierungsrat.

Testo completo

Januar 1997).

Parcel-wise leasing of agricultural land requires authorization; the authorization may be granted only if one of the statutory conditions is met.

The leasing of land is generally private law, but agricultural land is subject to the mandatory rules of the Federal Act on Agricultural Tenancy, including the authorization requirement for parcel-wise leasing.

Questione giuridica chiave

Whether the corporation council’s allocation decision is a public-law decision subject to administrative appeal.

Decisione estratta

The corporation council acts with sovereign effect when allocating corporation land for lease, and its individual decision on rights and duties qualifies as a decision under the Administrative Procedure Act that may be challenged by administrative complaint to the Regierungsrat.

Motivazione estratta

Corporation municipalities must observe both the Land Tenancy Act and § 41 of the Municipal Act; their rules on use rights must not lead to inequities. In that setting, management and use of corporation land are public-law tasks, so the corporate council is a public authority and its allocation decision is an administrative decision.
