Die Zuteilung von Saisonkontingentseinheiten richtet sich nach den Vorschriften von Art. 12 ff. BVO. Danach darf der Kanton Saisonbewilligungen nur im Rahmen der jährlich vom Bundesrat festgelegten Höchstzahl erteilen. Dieses vom Bundesrat festgelegte kantonale Saisonkontingent ändert sich je nach Wirtschaftslage von Kontingentsperiode zu Kontingentsperiode. Aufgrund dieser sich jährlich ändernden Kontingentssituation muss das kantonale Arbeitsamt die betriebliche Zuteilung im konkreten Fall regelmässig überprüfen. Es ist dabei durchaus richtig, die jeweiligen Zuteilungsentscheide vom Auftragsbestand eines Betriebes abhängig zu machen. Der Auftragsbestand ist nämlich ein zuverlässiger Hinweis auf den tatsächlichen Personalbedarf eines Betriebes. Daraus und insbesondere aus der Tatsache, dass der Bundesrat das kantonale Saisonkontingent gestützt auf Art. 12 Abs. 1 lit. b BVO periodisch neu festsetzt, lässt sich ableiten, dass aus einer Zuteilung der Vorperiode keine Ansprüche auf eine gleiche Zuteilung von Saisonkontingentseinheiten abgeleitet werden kann.
