Sintesi Omnilex

In a road-project approval case concerning the expansion of cantonal road K I 13, the court held that the expropriation right granted with the project is subject to the general expropriation cost rule: the Canton, as expropriator, must bear the procedural costs associated with deciding on the expropriation right. The ensuing costs consist of official and party costs. By contrast, the objectors, as expropriated persons, could not be burdened with these costs because no vexatious litigation was shown.

Questione giuridica chiave

Who must bear the procedural costs incurred in the project approval proceedings concerning the expropriation right for the road expansion?

Decisione estratta

Because the Canton exercises the expropriation right as holder of the road burden for cantonal roads, it must bear the procedural costs of the expropriation-right proceedings tied to the road project.

Motivazione estratta

Under the cited road statute, approval of the project grants the expropriation right where necessary; compensation is determined later if no settlement is reached. The expropriation right belongs to the Canton, and the expropriation act provides that the expropriator bears the costs. That rule applies to all expropriations, including the granting of expropriation rights in project approval proceedings.

Questione giuridica chiave

Can the costs of the expropriation-related proceedings be imposed on the objectors as expropriated persons?

Decisione estratta

No. The objectors could not be charged with those costs because they were not shown to have conducted the proceedings vexatiously.

Motivazione estratta

The expropriation statute allows shifting costs to expropriated persons only in cases of vexatious litigation. That prerequisite was absent here.
