The court holds that family reunification for a foreign national may be approved only if sufficient financial means are available for the maintenance of the family. In assessing this requirement, the authority may follow the SKöF public welfare guidelines. Those guidelines are intended to secure a social minimum and equal treatment of applicants; they are not replaced by the debt-enforcement subsistence minimum. The relevant monthly living costs of the foreign national and the joining family members must be covered by income, in line with the authority's discretionary power under Art. 4 ANAG.

Dem Ausländer kann der Familiennachzug nur dann bewilligt werden, wenn er u. a. über genügend finanzielle Mittel für den Unterhalt seiner Familie verfügt (Art. 39 Abs. 1 lit. c BVO). Die Vorinstanz hält sich bei der Beurteilung, ob genügend finanzielle Mittel vorhanden sind, an die Richtlinien der Schweizerischen Konferenz für öffentliche Fürsorge (SKöF). Damit ist auch eine rechtsgleiche Behandlung aller Gesuchsteller gewährleistet. Nach diesen Richtlinien sind die monatlichen Lebenshaltungskosten des Ausländers und der nachziehenden Familienmitglieder zu ermitteln. Die monatlichen Lebenshaltungskosten müssen durch das Einkommen gedeckt sein. Die Richtsätze der SKöF sollen nicht nur den unbedingt notwendigen Lebensbedarf, sondern ein soziales Existenzminimum sichern. Zur Ansicht, es sei das betreibungsrechtliche Existenzminimum heranzuziehen, kann bemerkt werden, dass damit von vornherein einem fürsorgerischen Risiko Vorschub geleistet würde. Tritt der Fürsorgefall ein, müssen die Leistungen wiederum nach Massgabe der höheren Ansätze des SKöF berechnet werden. Dieser unerwünschten Nebenwirkung, deren Vermeidung im öffentlichen Interesse steht, ist im Rahmen des pflichtgemässen Ermessens gestützt auf Art. 4 ANAG zu begegnen (Peter Kottusch, Zur rechtlichen Regelung des Familiennachzuges von Ausländern, im Schweiz.
