Der Beschluss von Strassengenossenschaften über den gemeinschaftlichen Bau von subventionierten Güterstrassen richtet sich nach § 39 des Kantonalen Landwirtschaftsgesetzes vom 12. September 1995 (LaG; SRL Nr. 902) und nach § 59 der Kantonalen Landwirtschaftsverordnung vom 3. November 1998 (LaV; SRL Nr. 903; vgl. auch Baudepartement des Kantons Luzern, Erläuterungen zum Strassengesetz, Dezember 1997, S. 40).

Gemäss § 96 LaV kann gegen Entscheide von Strassengenossenschaften unter Vorbehalt abweichender Bestimmungen innert 20 Tagen seit ihrer Zustellung beim Volkswirtschaftsdepartement Verwaltungsbeschwerde eingereicht werden. Eine solche abweichende Regelung ergibt sich aus den Bestimmungen des Strassengesetzes vom 21. März 1995 (StrG), wonach gegen den Beschluss von Güterstrassengenossenschaften beim Regierungsrat Verwaltungsbeschwerde eingereicht werden kann (§ 98 StrG). Diese Bestimmung gilt auch für den Beschluss zum Bau subventionierter Güterstrassen, ist doch nicht einzusehen, weshalb ein solcher Beschluss anders behandelt werden sollte, als die andern dort aufgeführten Beschlüsse (vgl. § 41 LaG, Baudepartement des Kantons Luzern, Erläuterungen zum Strassengesetz, Dezember 1997, S. 40). Da der Regierungsrat somit zuständig ist, ist auf die vorliegende Verwaltungsbeschwerde einzutreten.
