A notary asked whether the fee could be reduced under § 5 lit.b BeurkGebV when the same seller notarizes sales of several condominium units from the same land register sheet to different buyers. The answer was that § 5 lit.b BeurkGebV is to be interpreted restrictively. A reduction on the seller side is possible only if there is temporal unity, such as notarizations on the same day or at most on two consecutive days. If the public notarization is not completed, the reduction under § 5 lit.a BeurkGebV applies in addition.
§ 5 lit.b BeurkGebV; fee reduction for notarization of several condominium units by the same seller; the provision is to be construed restrictively. A seller-side reduction is available only where the notarizations form a temporal unit, in particular when they occur on the same day or at most on two consecutive days. If the public notarization does not come to completion, the fee reduction under § 5 lit.a BeurkGebV applies cumulatively.
Die Anfrage eines Notars, ob die Gebühr entsprechend § 5 lit.b BeurkGebV herabgesetzt werden könne, wenn der Notar den Verkauf mehrerer Stockwerkeigentumsgrundstücke mit gleichem Liegenschaftsblatt desselben Verkäufers an verschiedene Käufer beurkunde, wurde wie folgt beantwortet:
§ 5 lit.b BeurkGebV ist dem Grundsatze nach eher restriktiv auszulegen. Wenn zeitlich eine Einheit gegeben ist (z.B. Verurkundung mehrerer Stockwerkeigentumsgrundstücke am selben Tag oder höchstens an zwei aufeinanderfolgenden Tagen), kann auf "Verkäuferseite" eine Reduktion gewährt werden.
Kommt die öffentliche Beurkundung nicht zum Abschluss, so kommt die Reduktion entsprechend § 5 lit.a BeurkGebV zusätzlich zur Anwendung.
