Nach Art. 41 BV ist die Regelung von Herstellung, Beschaffung und Vertrieb von Waffen, Munition, Sprengmitteln und sonstigem Kriegsmaterial sowie die Ein- und Ausfuhr von Wehrmitteln Bundessache. Gestützt darauf hat der Bund das Kriegsmaterialgesetz erlassen. Neben der eidgenössischen Kriegsmaterialgesetzgebung bleibt für eine kantonale oder interkantonale Regelung reiner Exporte solcher Waffen kein Raum mehr (Art. 3 BV und Art. 2 UeB BV). Art. 9ff. des Kriegsmaterialgesetzes regeln die Ausfuhr von Kriegsmaterial nämlich abschliessend (vgl. Häberling Walter Rudolf, Waffenhandel, Erwerb, Besitz und Tragen von Waffen aus der Sicht des Nebenstrafrechts, Diss. Zürich 1990, S. 76f.). Zum gleichen Ergebnis kam das Bundesgericht schon in seinem unveröffentlichten Entscheid vom 24. März 1987 i. S. A. B. gegen Regierungsrat des Kantons Wallis. In Fällen, in denen der Ausländer erst im Ausland über die Waffe verfügen könne, sei es dementsprechend Sache der ausländischen Behörde, dafür zu sorgen, dass eine Waffe nicht in unbefugte Hände gerate. Der Schutzzweck des Waffenhandelskonkordates bezieht sich nur auf das Gebiet der Konkordatskantone oder allenfalls auch auf das Gebiet der übrigen Schweiz. Dieser Schutzzweck ist nicht gefährdet, wenn die Waffe durch die Post oder den Verkäufer ins Ausland transportiert wird (vgl. unveröffentlichter BGE vom 13.7.1987 i. S. R. R. gegen Statthalteramt des Bezirks Zürich und Obergericht des Kantons Zürich). Sicherheitspolizeiliche Vorschriften für das ausländische Staatsgebiet können wegen des völkerrechtlichen Territorialitätsprinzips nur durch den ausländischen Staat erlassen werden (vgl. Imboden/Rhinow, Schweizerische Verwaltungsrechtsprechung, Bd. I, Nr. 18 B I). Eine potentielle Gefahr für die öffentliche Sicherheit in der Schweiz wird erst dadurch geschaffen, dass der ausländische Käufer die tatsächliche Verfügungsgewalt über die Waffe schon in der Schweiz erhält. In diesen Fällen, in denen die Waffe dem Käufer bereits in der Schweiz überlassen wird, sind die Vorschriften des Waffenhandelskonkordates zu beachten (Häberling, a.a.O., S. 77).
