Die Beklagte hat nach Zustellung des Zahlungsbefehls nur gegenüber der Forderung Rechtsvorschlag erhoben, den Bestand des Pfandrechts aber nicht bestritten. Wer das Pfandrecht bestreiten will, muss dies ausdrücklich und zusätzlich erklären. Ohne eine derartige Erklärung wird angenommen, der Rechtsvorschlag betreffe nur die Forderung, nicht auch das Pfandrecht (Art. 85 Abs. 1 VZG), wovon auch vorliegend auszugehen ist (Amonn, Grundriss des Schuldbetreibungs- und Konkursrechts, 4. Aufl., § 33, Rz 11 S. 266 unter Hinweis auf BGE 105 III 120).
